Notification of energy infrastructure investments to serve the functioning EU internal energy market

Today, October 11, 2013 the Committee of Permanent Representatives (COREPER I) mandated the Lithuanian EU Council Presidency to enter negotiations with the European Parliament and European Commission on Proposal for a Regulation concerning the notification to the Commission of investment projects in energy infrastructure within the European Union and replacing Council Regulation (EU, Euratom) No 617/2010.

“The aim of the Regulation is to obtain the overview of the process of investment in energy infrastructure in the Union, by generating more and better data through biennial reporting by Member States. This will allow an improved, cross-sectoral analysis of needs, shortcomings, potential risks, and will therefore serve the functioning EU internal energy market by enabling better coordination, between Member States concerned and at Union level,” noted ambassador Arūnas Vinčiūnas, Chair of COREPER I, Deputy Permanent Representative of Lithuania to the EU. 

It is the intention of the Presidency to seek a first-reading agreement on this dossier. The first informal trilogue of co-legislators is scheduled for 16 October.

Background

The Court's ruling of 6 September 2012 was decided after the European Parliament took legal action against the Council in October 2010 contesting the legal basis used for the adoption of Regulation 617/2010 and requesting the Court to annul it (Case C-490/10). The Commission tabled the new proposal on 20 March 2013. On 26 September, 2013 the European Parliament's ITRE Committee voted on its opinion on this Proposal, and provided the EP rapporteur a mandate to negotiate with Council.
